Part I. General Provisions.
1. The present Regulation provides order, amounts and terms of fees payment for execution of juridical actions, relating to registration and entitlement to use TK, provided by the Law of the Kyrgyz Republic “On Protection of TK”.

2. Amount of fees, provided by the present Regulation, shall be established in the national currency of the Kyrgyz Republic – soms.

3. The fees established by the present Regulation, shall be paid in duly order, by transfer of relating amounts to bank account of the State Intellectual Property Service of the Kyrgyz Republic. Copy of payment order having a bank stamp or bank check of payment by cash or by transfer from personal account shall serve as documents confirming a fee payment. Document confirming fee payment, should contain registration number of application for registration and entitlement to use TK, or registration number for registration and entitlement to use already registered TK (hereafter referred as Application for ); or number of certificate on registration and entitlement to use ; or number of certificate on registration and entitlement to use already registered (hereafter referred as Certificate) as well as definition of juridical action to be paid by a fee. In the case when a registration number ob application for is not given, this document should contain a name of and name of applicant along with a definition of action, which was paid by a fee. Document that does not contain these data shall not be considered as valid.

4. Conformity of paid fee amount with the established amount shall be determined by date of payment.

5. Paid fee amount shall not be returned, excepting such cases when a payment was made in amount exceeding this one, established by the present Regulation, or when an action, paid by a fee had not been realized.

6. Exceeded fee amount shall be returned in duly order or, by petition of applicant, it shall be taken into consideration at other fees payment, provided by the present Regulation, on date of petition filing.

Document, certified a fee payment, shall be presented together with application filing for TK with the State Patent Service of the Kyrgyz Republic.

Document certifying fee payment, shall be presented during two months after receiving by applicant a decision on registration and/or entitlement to use TK.
Document certifying fee payment, may be presented during three months after two-month term expiring. In this case fee amount will be increased for 50%.

At failure to submit the document certifying fee payment in duly term and amount, registration of TK and certificate granting shall not be provided.

Publication of data on TK in Official Bulletin may be done at will of TK owner.
Document certifying fee payment, shall be provided during 3 months from date of entering these data into the State Register of TK.
At failure to submit the document certifying fee payment in duly term, publication in the Official Bulletin of data on TK shall not be provided.

Document certifying fee payment, shall be provided together with application for prolongation of term validity.
At failure to submit such document, certifying fee payment, application shall be invalid.

Document certifying fee payment shall be submitted together with petition for prolongation during 6 months from date of the last year expiring of registration validity.
At failure to submit the document, certifying fee payment in duly amount together with a petition, it will be considered as unfilled.

Document certifying fee payment for inserting of alterations shall be submitted together with application for alterations inserting.
At failure to submit together with application the document, certifying fee payment in duly amount, alterations into the State Register of TK shall not be filed.

Document certifying fee payment shall be submitted together with application for registration of agreement for TK use.
At failure to submit together with application the document, certifying fee payment in duly amount, registration of agreement for use of TK and alterations inserting into registered agreement shall not be done.
