On April 2, 2009 the State Patent Service of the Kyrgyz Republic arranged a round table discussion entitled “The pathways to improve the Patent Law of the Kyrgyz Republic”.
The round table discussion has been arranged within the framework of celebration of International and National day of intellectual property – April 26.
Prominent inventors, patent specialists, patent attorneys and Kyrgyzpatent employees participated in this event.
The aim of this roundtable is to identify the possible pathways to improve national patent legislation and to discuss with stakeholders concerned the proposals to make alterations and additions into the Patent Law of the Kyrgyz Republic.
A.Kazakbaeva and S.Bakeeva from the Division for Inventions, Utility Models and Industrial Designs Examination made presentations related to the event’s themes.
The following three proposals were provided for consideration:
1. To expand the range of objects, which are not covered by inventions.
2. To cancel the requirement to publish an application if no substantial examination has been made.
3. To introduce provisions on the restoration of a patent validity and right of subsequent use.
After hearings and discussion of reports and presentations, as well as comments and remarks, the round table participants expressed their interest to improvements of effective patent legislation on the mentioned areas and recommended to take into consideration the opinions of all stakeholders in the field of intellectual property when elaborating a new draft law.
