Legal Department

The Legal Department consists of the following divisions:

– Division of Intellectual Property realization and Appellations;
– Regulatory and Methodology Division.
In accordance with given functions the Legal Department executes the following works:
– working out of drafts of normative and legal acts in the field of intellectual property;
– generalization of experience of applying the legislation of the Kyrgyz Republic related to protection of intellectual property subject matters;
– preparation of documents for conclusion of international agreements in the field of intellectual property;
– preparation of proposals on implementation of international agreements norms to the national legislation of the Kyrgyz Republic and development of national legislation in accordance with the international legal norms;
– development and improvement of the legislation in the field of intellectual property;
– functions of Secretariat of Interdepartmental Commission to prevent violations in the field of Intellectual Property;
– execution of commitments related to the Agreement on Trade- Related Aspects of Intellectual Property Rights in the framework of the World Trade Organization;
– preparation of materials on objections consideration for decisions of the State examination to applications for titles of protection granting, which are filed to the Appellation Board of the State Patent Service of the Kyrgyz Republic in accordance with terms provided by legislation and participates as well;
– conducting of analysis in the field of legal protection of intellectual property;
– working for international cooperation fulfilling on legal protection and usage of intellectual property subject matters, measures directed to liabilities realization of the Kyrgyz Republic under international agreements and treaties, foreign experience studying and using;
– lawsuits execution and representation of the State Patent Service of the Kyrgyz Republic at courts;
– legal and information assistance by requests to natural and juridical persons, if it is in the competence of the State Patent Service of the Kyrgyz Republic.

Information Support and State Registers Department

The Information Support and State Register Department is represented by the following divisions:

– IT Division;
- Division of Exhibition Activities and Information Support;
– State Register and License Treaty Registration Division.
The Department performs the following duties:
– informational services to specialists of the State Patent Service of the Kyrgyz Republic in the field of Intellectual Property;
– development of automated system of management of informational resources of the State Patent Service of the Kyrgyz Republic;
– development, updating and maintenance of the official website of the State Patent Service of the Kyrgyz Republic;
– management, modernization and provision of the official web site;
- management, modernization and provision of local network functioning;
– making suggestions on acquisition for the Fund of normative legal and methodic literature in the field of protection of the rights for IP subject-matters;
– elaboration of instructions on the work with computers, databases, information networks;
– establishment, updating, software and technical service of corporative network;
– maintenance and ensuring the work of office equipment and software;
– inserting of information on intellectual property subject matters to relevant State Registers;
– inserting of information on patent attorneys of the Kyrgyz Republic to the State Register of patent attorneys;
– preparation of materials for publication of information on intellectual; property subject matters in the official editions of the State Patent Service of the Kyrgyz Republic;
– preparation of titles of protection for intellectual property subject matters for issuance;
– conducting of work related to recording for keeping in force the intellectual property subject matters, introduction of amendments and extension of registration’s validity;
– conducting of work on development of automated system of intellectual property subject registration and issuance of title of protection;
- registration of agreements on rights transfer for intellectual property subject matters;
– registration of treaties on transferring intellectual property subject matter rights and license agreements, concluded by the Center of Collective Management of economic rights of authors with users of copyright and related rights subject matters.

Department of Industrial Property and Selection Achievements Examination

The system of industrial property and selection achievements examination is one of the most important elements of the national system for protection of IP subject-matters. It is presented now by the following two divisions and one sector:

– division for examination of inventions, utility models and industrial designs;
– division for examination of trademarks, appellation of origin and firm names;
– sector for examination of selection achievements.

Department of industrial property and selection achievements examination executes the following functions:

– conducting of the state examination of applications for issuance of titles of protection for industrial property and selection achievements subject matters;
– making up of necessary materials related to industrial property subject matters and selection achievements for publication in official editions of the State Patent Service of the Kyrgyz Republic;
– arranging workshops and round tables on issues of Industrial Property and Selective Achievements;
– work on organization of exhibitions and competitions of scientific and technical as well as artistic and design creativity.

Department of the Official Publications and Translation

The Department consists of two divisions:

– Material Preparation and Translation Division;
– Polygraphy Division.

This Department prepares and publishes the following editions:

– official editions, containing data on IP subject-matters;
– normative legal editions, effective in the field of IP protection;
– reference, study, methodic editions on IP, as well as scientific or applied editions;
– popular scientific editions, informational, analytical editions on IP issues, as well as advertising and other editions.

Copyright and Related Rights Department

Copyright and Related Rights Department consists of the following divisions:

– Inspectorial division;
– Sector for registration of copyright, related rights subject matters, authors and right holders;
– Audiovisual piracy analysis sector;
– South Region division.
In accordance with its tasks the Copyright and Related Rights Department has the following duties:
– consideration of applications for state registration of Copyright and Related Rights subject-matters, maintenance of database for calculation of works and authors;
– work with Copyright owners for obtaining authorities to administer their economic rights on the collective base;
– conclusion of licensing agreements with users to use works and Related rights subject-matters and coordination with users of size of remuneration and other conditions;
– calculation of users of Copyright and Related rights subject matters and payers of remuneration;
– collection of remuneration for use of Copyright and Related rights subject matters;
– preparation of consolidated reports on used subject matters in order to distribute royalties;
– distribution and payment of collected royalties to represented Copyright and Related rights owners;
– conducting of records and supervision of duly and timely fulfillment of terms of license agreements;
– conducting of analytical survey of audio and video piracy and develop recommendations to its reduction;
– cooperation with police bodies of the Kyrgyz Republic in combating against audiovisual piracy;
– methodic aid to cultural and artistic institutions as well as to companies and institutions in issues of legal protection of Related Rights;
– duties of the Secretariat of Presidiums of the Board of Related Rights holders and Board of Authors.

Education and Research Department

The Education and Research Department consists of:
– Interuniversity Chair “Intellectual Property”;
– Intellectual Property Research Division.

The Department fulfils the following main functions:

- training of scientific and pedagogic personnel in the field of intellectual
property through postgraduate studies on the base of established state educational standards;
- planning and organization of scientific work of teaching staff of the Chair with students attraction; development and approval of individual plans of master’s and postgraduate degrees;
- organization of advanced training of specialists from ministries, agencies and heads of companies, organizations and firms of different forms activities and ownership as well as workers of patent and license services and specialists in the field of marketing through the advanced training courses; training of specialists in the field of intellectual property;
- establishment of creative links with other institutions chairs; learning, summarizing and distribution of the best professors’ experience; organization of pedagogical and professional trainings for assistants and professors;
- consideration of the Chair members’ theses or other applicants’ theses by commission of Director of the State Patent Service of the Kyrgyz Republic;
- cooperation with domestic Institutes of high education, enterprises, firms, offices in order to studying, generalization and distribution the advanced experience, modern technologies of teaching, arrangement of joint researches and programs; organization of skill raising for higher educational specialists; communication with post graduate students;
- elaboration of text-books, tutorials, educational and methodic materials for trainings listeners;
- cooperation with relevant foreign departments of universities and research organizations on teaching and methodological and research work as well as with foreign researchers of correspondence profile.

Human Resources and Office Management Division

The Division executes the following functions in accordance with its tasks:

– arrangement of work on implementation of normative and legal acts, decrees, orders in structural divisions;
– implementation of personnel policy, formation of personnel selection and assignment of necessary specialties and qualifications, according objects, strategy and profiles of activities of the State Patent Service of the Kyrgyz Republic on the base of competition;
-formation of personnel reserve, execution of measures for personnel training and skill arising, conducting of quality composition analysis and practical recommendations for its improving;
- organization of attestation and qualification examination for staff as well as development of events for realization of attestation commissions decisions;
- control of labor discipline and estimation of internal labor order by officials of the State Patent Service of the Kyrgyz Republic;
– receiving, taking into consideration and delivering the incoming correspondence, working documents and other outgoing documentation;
– analytical references on control and check of quality execution of documents;
– receiving of application documents of intellectual property subject matters from applicants and patent attorneys;
– control and accounting timely of documents movement, every quarter generalization and submitting to the Board of the State Patent Service of the Kyrgyz Republic the outcomes of letters’ consideration and people’s applications;
– conducting of correspondence and exchange by editions between patent offices of the CIS countries and foreign countries;
– subscription to periodical editions.

International Relations Division

In accordance with given tasks the Division submits proposals to the leadership of the State Patent Service of the Kyrgyz Republic regarding determination of main concepts and trends of international cooperation in the field of intellectual property.
It executes the international cooperation by exchange of patent-technical information, documentation and as a whole intellectual property subject matters protection; it also realizes the following functions:

- development of drafts agreements with international organizations and patent offices of the CIS countries and foreign countries, proposals on conclusion, execution and cessetion of agreements;
- fulfilling of general observance of interdepartmental agreements execution concluded by the State Patent Service of the Kyrgyz Republic;
- execution of deposit functions relatively interdepartmental agreements concluded by the State Patent Service of the Kyrgyz Republic;
– arrangement of international workshops, conferences and other events on international level.

State Fund of Intellectual Property

Currently the IP State Fund structure is such as follows:
– sector of marketing and commercialization of IP subject-matters;
– sector of organizational maintenance and management;
– accounts department.
The main duties of the State IP Fund are as follows:
– collection and distribution of information on effective and competitive national and foreign developments, containing IP subject-matters, updating and maintenance of appropriate database;
– making suggestions on the promotion of creative activities of authors, inventors and innovators, scientific workers, cultural and artistic workers;
– systematic analysis in the field of creation and use of IP subject-matters, development trends of science and technique;
– arranging and carrying out the exhibitions, competitions, workshops, symposiums, scientific theoretical and practical conferences in the field of Intellectual Property and innovations;
– marketing researches in the field of Intellectual Property, including their use in various industries;
– rendering the consulting and reference services in the field of creation and provision of legal protection and use of IP subject-matters;
– financial support of inventors, innovators, scientific, cultural and artistic workers free of charge and on credit;
– assistance in foreign patenting of national developments and purchase of patents on behalf of the State;
– making suggestions on making alterations and additions into the effective legislation in the field of Intellectual Property;
– elaboration of proposals on evaluation and commercialization of IP subject-matters;
– consulting and reference services on cost estimating of IP subject-matters and other subject-matters subject to estimation;
– training of specialists on management and involvement of Intellectual Property into economic turnover;
– other activities, which are not contrary to the Fund’s aims and are not forbidden by the Law.

State Patent Technical Library (SPTL)

The SPTL is the lower organization of the State Patent Service of the Kyrgyz Republic. The SPTL is a public, scientific-sectoral library, forming information resources on real sector of the national economy, as well as the assistance to scientific, innovative and inventive activities.
The SPTL information funds include:
– full descriptions of inventions to applications and patents of Kyrgyzstan, EPO, WIPO, EAPO, USA, Russia, Germany, Japan, UK, France, Switzerland;
– international, interstate and national standards, technical conditions, building norms and rules;
– scientific and technical literature and periodical editions on technics and economics for students, scientists, managers and entrepreneurs;
– foreign editions from 17 countries on architecture and building, light and processing industries, computer engineering;
– editions of Kyrgyzstan.
On the basis of present funds the specialists of SPTL make information resources of second information:
– review and abstract information by materials of local press;
– bibliographic indexes on topic themes.
The Library takes part in corporate projects.
Readers’ requests are satisfied by subscription, in reading rooms, by inter-library exchange system, by e-mail, fax, by copying, scanning, agreement services, by written references on compliance of issued production with acting standards, by verbal factual references and consultations on applications composition for subject matters of industrial property and copyright, execution of patent searches.
Along with access to information resources and library’s services readers may use the division of electronic information. They profit through Internet by resources of 60 patent offices from all over the world, the EBSCO, by editions of Hanoverian technical library on INTAS programs.
By educational institutions’ requests thematic exhibitions of literature on topic themes are organized as well as new editions for the Office’s events. The library carries out exhibitions in the Chamber Commerce, makes publications in mass media, sets the information on web site of the State Patent Service of the Kyrgyz Republic, USAID, Research Center “Toktom”, Social Fund “Adviser”, Congress of business-associations etc.
