International cooperation of Kyrgyzpatent

In the field of international cooperation the State Service of Intellectual Property and Innovation under the Government of the Kyrgyz Republic (hereinafter  Kyrgyzpatent) has close ties with the World Intellectual PropertyOrganization (WIPO), whose members include 185 countries. Within the framework of intergovernmental and interagency agreements Kyrgyzpatent continues to actively develop cooperation with international organizations such as the European Patent Office (EPO), the Eurasian Patent Organization (EAPO), the Confederation of Societies of Authors and Composers (CISAC), as well as other foreign intellectual property offices (IP) and IP departments of the CIS countries.

Cooperation with the WIPO

The World Intellectual Property Organization (WIPO) is a United Nations agency dealing with IP (patents, copyright, trademarks, designs, etc.) as a means of stimulating innovation and creativity. WIPO promotes innovation and creativity for economic, social and cultural development of all countries through a balanced and effective international intellectual property system.
Kyrgyzpatent represents the interests of Kyrgyzstan in WIPO taking an active part in the work of the governing bodies and committees of WIPO. Kyrgyzstan is a member of WIPO since 1994being party of 23 internationalagreements, 21 of which are signed within WIPO.
Kyrgyzpatent undertakes efforts coordinated by WIPO to harmonize the relevant national regulations.Harmonization aimed at establishing identical or compatible procedures and acquisition of IP rights protestdispute resolution, anti-infringement of IPRs.
Since 1995, almost every year international seminars under the auspices of WIPOare implemented in Kyrgyzstan on IP protection, which facilitates the integration of the IP system of Kyrgyzstan into a similar world system. At international seminars and conferences organized by WIPOthe Office’s staff improves their knowledge and skillshas the opportunity to exchange experiences with colleagues from other countries.

By technical assistance program of WIPO Kyrgyzpatent was repeatedly assisted in the acquisition of modern equipments and trainings for qualified personnel. WIPO constantly provides advice for development of the draft Law on IP protection and other protection issuesby sending of information literature.
As a result of the long-term cooperation with the WIPO Academy a distance learning course “Introduction to Intellectual Property” in Russian and English successfully operates in Kyrgyzpatent. The course provides insight into the underlying objects of IP, as well as on the functioning of the international instruments in this fieldAccording to the results of training the certificate are issued to officialsStaff trained in the distance course, have the opportunity with the support of WIPO to undergo training at the leading IP offices in Europe.

In 2001 the Program of cooperation between the Government of the KR and WIPO was signed, which aims at jointactions implementation to improve the Kyrgyz IP legislationstrengthening the technical facilities and training ofhuman resources. The program also provides the improvement of methods of combating against piracy andinfringements of IP.
Every year on April 26, the Kyrgyz Republic celebrates the World and National Intellectual Property Dayestablished by the General Assembly of WIPO and the Government of the Kyrgyz Republic with the participation ofrepresentatives of UNDP. During these events the WIPO prestigious awards  Gold medals are given to the best inventors, scientists, writers and musicians of the KR.
The agreement was reached with the WIPO Director General Dr. F.Gurry on assistance to our country for development and implementation of the National Strategy of the Kyrgyz Republic on IP and Innovation Development. In recent years between Kyrgyzpatent and WIPO the following agreements were signed:
 Service Level Agreement (TISC) (September 2010).
– Agreement on the Cooperation (February 2012).
– Cooperation Agreement for the Development of IP Office Business Services (August 2012).

The Kyrgyz Republic is a member of UPOV (International Union for New Varieties Protection Plantswhich is part ofWIPO) and Kyrgyzpatent representatives regularly participate in seminars and trainings conducted by the Union.

Cooperation with the Eurasian Patent Office (ЕАPO)  

The Kyrgyz Republic ratified the Eurasian Patent Convention (EAPC) in 1995 and joined the Eurasian Patent Organization with headquarters in Moscow. The Convention aims to recreate the joint patent space in the territories of the CIS countries. The EAPO has the status of intergovernmental legal entity and capacity attributed to legal entities inaccordance with the national law of that State.
Head of Kyrgyzpatent as Plenipotentiary of the Kyrgyz Republic annually participates inthe meetings of the Administrative Council of the EAPO. Kyrgyzpatent employees regularly participate in seminars and scientific conferences held under the EAPC.
On the basis of the Eurasian Patent Office in accordance with the program of internships for the States Parties to the EAPC Kyrgyzpatent specialists are trained annually on examination and protection of IP. Since 2002, the Eurasian Patent Office annually finances training of Kyrgyzpatent specialist in the Russian State Academy ofIntellectual Property (RGAIS) in the direction of “Intellectual Property.” As a result, a number of our Office staffgraduated in absentia RGAIS and received diplomas on vocational training.
Currentlyaccording to the quota provided for in the Administrative Instructions EAPC for the Kyrgyz Republicseveral employees of Kyrgyzpatent work for EAPO system, increasing their knowledge and professional experience.

Cooperation with European Patent Organization (EPO) and European Patent Office.

European Patent Organization with the headquarter in Munich is an intergovernmental bodywhich was established on 7 October, 1977 on the basis of the European Patent Convention and consists of the European Patent Office and the Administrative Board, which oversees the work of the department.
Kyrgyz Republic carries out fruitful cooperation with the EPO.
EPO provides advice and methodological assistance, provides with patent and technical literatureEPO spendsannually to 5 international workshops on the protection of industrial property in Munich and Vienna and The Haguebranches. Some of these events at financial support of the EPO were trained our Office specialists where they increased knowledge and skills.
From 2001 to 2010 the EPO funded teaching of English and French (for the 4 groups of Kyrgyzpatent officials).

Cooperation with the UN Economic Commission for Europe

At its first meeting, held on 27-28 September 2006 in Geneva, the newly created Committee on Economic Development and Integration Economic Commission for Europe of the United Nations (UNECE), established under its auspices, the Expert Group on Intellectual Property (TOS-IP), aimed at consideration of issues related to the role of IP in economic development of the Member States of the UNECE, focusing on countries with economies in transition. Kyrgyzpatent employees participated in the third, fourth, fifth, sixth and seventh annual sessions TOS-IP. Sessions considered range of important issues in the area of international researches and development, as well as some of the problems of international enforcement of IP.
In May 2011, with the support of the UNECE the regional seminar on commercialization and evaluation of IP was organized in Bishkek.

USAID

Financial assistance was provided to Kyrgyzpatent by USAID for purchasing the software CoSIS for database formation in the field of copyright and related rights.
The training for customs and Kyrgyzpatent specialists by the program “Prevention of offenses in the sphere of IP”  was conducted in 2011 in Bishkek at USAID financial support with participation of teachers from the Russian State Academy of Intellectual Property (RGAIS, Moscow).

Interstate Council on Intellectual Property Legal Protection 

Interstate Council on Intellectual Property Legal Protection was created in accordance with the Agreement on cooperation in the field of legal protection of IP on November 19, 2010 (hereinafter – MGSIS). It is formed from plenipotentiary representatives of the Agreement parties and their alternates appointed by the governments.
MGSIS operates in close collaboration with the Executive Committee of the CIS countries, the Eurasian Patent Office, the World Intellectual Property Organization, the European Patent Office and other international organizations.
In June 2012 the first meeting of MGSIS under the chairmanship of Kyrgyzpatent
took place in Kyrgyzstan.

Interdepartmental cooperation is based on bilateral agreements signed with IP offices of Austria, Finland, China, Turkey, Hungary, Poland. It provides the exchange of information, participation in joint seminars and trainings. The Memorandum on Cooperation with US Patent and Trademark Office is now on stage of approval, as well as the Treaty on mutual representation of interests in the field of public performances between Kyrgyzpatent and Public Union “Azerbaijan Authors’ Society”.
